Your privacy matters to us.
Agensive Inc. ("Agensive", "we", "our", or "us") operates an AI-powered receptionist service for service businesses. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform, website, or services.
By accessing or using Agensive, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with its terms, please discontinue use of our services.
This policy is effective as of January 1, 2025, and applies to all users of our services.
What we collect, and why.
We collect information you provide directly to us, including: name, business name, email address, phone number, billing information, and any other details you submit when creating an account or contacting us.
We automatically collect certain information when you use our services: IP address, browser type, operating system, referring URLs, device identifiers, pages viewed, and the date and time of your requests.
When you use our AI receptionist features, call recordings, transcripts, and related metadata may be collected and stored to provide and improve the service. You are responsible for notifying callers of recording in accordance with applicable law.
Powering your service.
We use collected information to: provide, operate, and maintain our services; process transactions and send related information; send administrative information, updates, and security alerts; respond to your comments, questions, and requests; and send marketing communications (where permitted by law).
We use call data and transcripts to train and improve our AI models, detect fraud and abuse, comply with legal obligations, and analyze usage trends. Aggregated or de-identified data may be used for any business purpose.
We will not sell your personal information to third parties for their independent marketing or advertising purposes without your explicit consent.
When we share your data.
We may share your information with third-party vendors and service providers that perform services on our behalf, such as payment processing, data analysis, email delivery, cloud hosting, and customer service. These providers are contractually obligated to protect your data.
We may disclose your information if required by law, subpoena, or other legal process; if we believe disclosure is necessary to protect the rights, property, or safety of Agensive, our users, or the public; or in connection with a merger, acquisition, or sale of all or a portion of our assets.
We do not share your personal information with third parties for their independent marketing purposes without your consent.
How long we keep it.
We retain personal information for as long as necessary to fulfill the purposes outlined in this policy unless a longer retention period is required by law. Account data is retained for the duration of your account and for a reasonable period afterward.
Call recordings and transcripts are retained for up to 24 months by default. You may request earlier deletion by contacting us. Billing records are retained for a minimum of 7 years as required by applicable tax and financial regulations.
When we no longer need your data, we will securely delete or anonymize it.
You are in control.
Depending on your location, you may have the right to: access the personal information we hold about you; correct inaccurate or incomplete data; request deletion of your personal information; object to or restrict processing; and receive a portable copy of your data.
To exercise any of these rights, please contact us at privacy@agensive.com. We will respond to your request within 30 days. We may need to verify your identity before fulfilling certain requests.
You may opt out of marketing emails at any time using the unsubscribe link in any email we send. Even if you opt out, we may still send you transactional or administrative messages.
Protecting what's yours.
We implement industry-standard security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures include encryption in transit (TLS), encryption at rest, access controls, and regular security assessments.
No method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach affecting your rights, we will notify you as required by applicable law.
